City of Fort Stockton Resolution to Change General Election Date

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FORT STOCKTON, TEXAS MAKING THE FOLLOWING CHANGES TO THE CITY’S GENERAL ELECTION PURSUANT SENATE BILL 2258, EIGHTY-EIGHTH REGULAR LEGISLATURE: CHANGING THE CITY OF FORT STOCKTON’S ELECTION DATE FROM THE MAY UNIFORM DATE ESTABLISHED BY LAW TO THE NOVEMBER UNIFORM DATE ESTABLISHED BY LAW AND PROVIDING FOR THE HOLDOVER OF THE MAYOR AND CITY COUNCIL MEMBERS TO CONFORM TO THE NOVEMBER UNIFORM ELECTION DATE; ADOPTING LENGTH OF TERMS FOR THE MAYOR AND CITY COUNCIL MEMBERS, ESTABLISHING ELECTION PROCEDURES FOR FUTURE MUNICIPAL GENERAL ELECTIONS, PROVIDING FOR SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the Senate Bill 2258 was passed in the 88th Texas Legislature which concluded May 16, 2023, and signed by the Governor of Texas on May 27, 2023; and

WHEREAS, Senate Bill 2258 allows Municipalities with a population of 9,000 or less, located predominantly in a county that has a total area of less than 4,800 square miles that has adopted a council-manager form of government to take action to move their elections to the November uniform election date so long as the action to do so is completed by December 31, 2024; and

WHEREAS, Fort Stockton Mayor and Council Members serve three (3) year terms with a General Election held annually on the May uniform election date; and

WHEREAS, it is the desire of the Fort Stockton City Council to change the General Election to the November uniform election date beginning November 2024; and

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT STOCKTON, TEXAS:

WHEREAS, the City of Fort Stockton current City Council Members Place #3 (Ruben J. Bernal), Place# 4 (James B. Warnock) and Place #5 (Darren Hodges) elected in May 2022, will holdover from May 2024 until November 2024; and

WHEREAS, the City of Stockton current Mayor (Paul Casias) and City Council Members Place #1 (Paul Jerome Chavez) and Place #2 (Ruben Falcon), elected in May 2023, will holdover from May 2026 until November 2026; and

WHEREAS, the citizens of the City of Fort Stockton shall elect three (3) Council Members for a three (3) year term on the uniform election date in November 2024, and shall elect the Mayor and two (2) Council Members for a three (3) year term on the uniform election date in November 2026; and

WHEREAS, the City of Fort Stockton will hereinafter contract with Pecos County Elections office in holding and conducting the November uniform election to be administered by the Elections Administrator of the County beginning annually on the November 2024 uniform election date;

THAT by virtue of adoption of Resolution#: 23-122R, the City Council hereby approves that all future City of Fort Stockton General Elections shall be held as written in this resolution beginning annually on the November 2024 uniform election date.

Should any provision of the Resolution be held invalid or unconstitutional the remainder of such Resolution shall not be deemed to affect the validity of any other provision of said Resolution.

AND IT IS SO RESOLVED that this resolution shall become effective January 1, 2024.
