5. Court to consider and/or act upon approving a Resolution Designating and Establishing the Pavo BESS Reinvestment Zone on UNIVERSITY LANDS U85, BLK19, SEC551, under the Provisions of the Texas Tax Code 312 et seq.

6. Court to Consider and/or act upon Accepting, Approving and Executing a Tax Abatement Agreement with Pavo BESS, LLC on UNIVERSITY LANDS U85, BLK19, SEC551, for the Construction of a Battery Energy Storage System, with Capacity of 170MW. Estimated Project Cost of $62,000,000 under the Provisions of Texas Tax Code 312 et seq., and accept a $1,000.00 Payment to Pecos County to cover Local Administration Costs associated with processing the Application.
